Glompi's Terms of Service

Who We Are

Glompi (“we,” “us,” or “our”) operates the website glompi.com (the “Site”). We provide comfortable and durable bedding products. These Terms govern your use of the Site and any related services.

Business Info & Platform

Our business: Space Global, LLC — 4440 Sheridan St, STE A, Hollywood, FL 33021, United States. Our store is hosted on Shopify Inc., which provides the e-commerce infrastructure enabling us to sell our products. Glompi has no control over Shopify’s infrastructure or practices and assumes no liability for them.

Acceptance of Terms

By accessing or using the Site, you agree to these Terms of Service. If you do not agree, please do not use the Site. We may update these Terms at any time; continued use after updates constitutes acceptance of the revised Terms.

License to Use Our Site

Subject to these Terms, we grant you a revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use.

Eligibility & Account

Pricing, Accuracy & Currency

Prices are shown in USD unless stated otherwise and may change without notice. We strive for accuracy but cannot guarantee that product descriptions, pricing, or availability are error-free. If a material error is discovered, we may correct it or cancel affected orders.

Ordering & Payment

By placing an order, you represent that you are authorized to use the selected payment method. We may refuse, cancel, or limit orders (e.g., suspected fraud, inaccurate information). Shipping & Risk of Loss

Shipping costs, timelines, and methods are outlined in our Shipping Policy. Risk of loss passes to you when the order is delivered to the carrier. Tracking information will be provided when available.

Return & Refund Policy

Warranty

Eligible products are covered as described in our Warranty Policy. The warranty does not cover normal wear, misuse, improper care, or alterations.

Warranty Disclaimer & Limitation of Liability

Glompi and its affiliates disclaim implied warranties (including merchantability, fitness for a particular purpose, and non-infringement) to the fullest extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data. For product-related claims, our maximum aggregate liability will not exceed the amount you paid for the product(s) giving rise to the claim. Nothing here limits liability that cannot legally be limited.

Indemnification

You agree to indemnify and hold harmless Glompi (and its affiliates, officers, agents, and employees) from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any third-party rights.

Governing Law & Disputes

Governing Law. These Terms and any non-contractual obligations arising out of or relating to them are governed by U.S. federal law and the laws of the State of Florida, without regard to conflict-of-law principles.

Informal Resolution. Before filing a claim, you agree to email us at hello@glompi.com with “Dispute Notice” in the subject line and a brief description of the dispute. We will attempt to resolve the dispute informally within 30 days.

Arbitration (Where Permitted by Law). Except for the exceptions below, any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted by one arbitrator, which may occur by video, phone, or in person in Broward County, Florida. The arbitrator may award individual relief permitted by law.

• Exceptions. Either party may bring (a) an individual action in small-claims court; or (b) a lawsuit solely for injunctive relief to stop unauthorized use or abuse of the Site or infringement of intellectual-property rights.
• Class-Action Waiver. To the fullest extent permitted by law, disputes will be arbitrated only on an individual basis and not as a class or representative action. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) must be litigated in court and not in arbitration.
• Opt-Out. You may opt out of arbitration within 30 days of first agreeing to these Terms by emailing hello@glompi.com with the subject line “Arbitration Opt-Out” and your name and address.

Court Venue. If arbitration is not available or the class-action waiver is found unenforceable, disputes will be resolved exclusively in the state or federal courts located in Broward County, Florida, and both parties consent to jurisdiction and venue there. This section applies only to the extent permitted by law and does not limit any non-waivable consumer rights.

Changes to These Terms

We may update these Terms from time to time. Updates take effect when posted with a revised “Last updated” date. Your continued use of the Site constitutes acceptance of the updated Terms.

Entire Agreement

These Terms, together with all referenced policies (including our Privacy, Payment, Shipping, Return & Refund, and Warranty Policies), constitute the entire agreement between you and Glompi regarding the Site and supersede all prior agreements on the same subject. If any provision is deemed unenforceable, the remaining provisions remain in effect. No waiver of any term is a continuing waiver.
